Please read these Terms of Service ("Terms") carefully before using the SiteSmartly platform ("Service") operated by S2V Technology ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By registering for or using SiteSmartly, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms, and agree to comply with them. If you are using the Service on behalf of a company or organisation, you represent that you have authority to bind that entity.
2. Description of Service
SiteSmartly is a cloud-based construction management platform that allows builders and contractors to manage sites, clients, payments, employees, attendance, payroll, and materials. The Service is provided on a subscription basis with a free tier and paid plans.
3. Account Registration
You must provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at s2vtechnology.in@gmail.com if you suspect unauthorized access to your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the Service or its systems
- Upload or transmit viruses, malware, or other harmful code
- Resell, sublicense, or commercially exploit the Service without our written permission
- Use the Service to store or transmit infringing, defamatory, or otherwise unlawful content
- Interfere with or disrupt the Service's infrastructure
5. Subscription and Payment
Paid plans are billed in advance on a monthly or yearly basis. Prices are listed in Indian Rupees (INR) including applicable taxes. We reserve the right to change pricing with 30 days' notice to existing subscribers. Failure to pay subscription fees may result in suspension or downgrade to the free plan.
6. Data Ownership
You retain full ownership of all data you enter into SiteSmartly, including site information, client data, employee records, and financial data. We do not claim ownership of your data. You grant us a limited license to store and process your data solely to provide the Service to you.
7. Intellectual Property
The SiteSmartly platform, including its design, code, branding, and documentation, is owned by S2V Technology and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.
8. Service Availability
We strive to maintain high availability but do not guarantee that the Service will be uninterrupted, error-free, or available 100% of the time. We may take the Service offline for maintenance with reasonable advance notice where possible.
9. Limitation of Liability
To the maximum extent permitted by applicable law, S2V Technology shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption, arising out of or related to your use of the Service. Our total liability for direct damages shall not exceed the amount paid by you for the Service in the three months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service is free of bugs or errors.
11. Termination
You may cancel your account at any time from within the app or by contacting us. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your access to the Service ceases, and your data will be retained for 30 days before permanent deletion.
12. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of India.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
